Website content does not create a professional, clinical, medical, therapeutic, or client relationship between you and Clearpath.
Submitting a contact form, sending an email, calling Clearpath, or requesting information does not guarantee that Clearpath will accept an engagement or provide services. A client relationship begins only after Clearpath and the appropriate client, responsible party, or authorized representative enter into a written service agreement.
Unless expressly stated otherwise in writing, Clearpath sober companion services are nonmedical and nonclinical support services.

Clearpath services are not a replacement for care from a physician, licensed therapist, treatment center, emergency professional, or other appropriately licensed provider. Clients should follow the instructions of their licensed healthcare and treatment professionals.
This website is not monitored continuously and must not be used to request emergency assistance.
If you or another person may be experiencing a medical emergency, overdose, severe withdrawal symptoms, immediate danger, or another urgent crisis, contact emergency services immediately.
Clearpath does not guarantee that a website inquiry, email, voicemail, or text message will be reviewed within any particular period.
Recovery is highly personal and may be affected by factors outside Clearpath's control.

Applicable fees, deposits, payment schedules, reimbursable expenses, and accepted payment methods will be stated in the client's service agreement or written proposal.
Unless otherwise stated in writing, clients or responsible parties are responsible for authorized travel, lodging, transportation, meals, parking, admission, and other reasonable engagement-related expenses.
Cancellation, rescheduling, deposit, and refund terms for paid services will be stated in the applicable service agreement.
A general website inquiry may be withdrawn at any time before a service agreement is signed.
Clearpath may require advance payment or a nonrefundable deposit when reserving personnel, travel dates, overnight engagements, or extended services.
Any nonrefundable amount will be clearly identified before payment is accepted.
Clients and responsible parties must provide accurate, complete, and timely information reasonably necessary to evaluate and provide services.

Clients must not intentionally conceal information that could create a serious risk to themselves, Clearpath personnel, or others.
Clearpath may modify, suspend, or terminate services if material information is withheld or misrepresented.
Clearpath personnel do not prescribe, alter, recommend, or independently administer medications unless specifically qualified, legally authorized, and expressly engaged to do so in writing.
When permitted by the service agreement, a sober companion may provide nonclinical reminders based on written instructions established by the client or an authorized healthcare professional.
Clients remain responsible for following the directions of their licensed medical providers.
Transportation or travel support may be offered only when agreed upon in writing.
Clients must follow reasonable safety instructions while traveling or riding in a vehicle.
Clearpath may refuse transportation when a client's behavior creates an immediate safety risk, violates applicable law, or makes safe transportation impractical.
Travel-related arrangements, identification requirements, tickets, lodging, expenses, cancellations, and schedule changes will be addressed in the applicable service agreement.
Clearpath handles personal, medical, and recovery-related information according to its Medical Privacy Policy, applicable service agreements, authorizations, and applicable law.
When HIPAA, the HITECH Act, 42 C.F.R. Part 2, or another privacy requirement applies to particular information, Clearpath will seek to handle that information according to the applicable legal requirements.
Not every website communication or sober companion engagement is automatically governed by HIPAA.
Please review our Medical Privacy Policy for more information about information we collect, how information may be used, authorized disclosures, privacy rights, security practices, substance-use-disorder information, and privacy complaints. The Medical Privacy Policy is incorporated into these Terms by reference.
By contacting Clearpath electronically, you acknowledge that ordinary email, text messaging, voicemail, and standard website forms may not be fully secure.
Do not submit detailed diagnoses, medical records, medication lists, treatment documents, insurance information, government identification numbers, or other highly sensitive information through an unsecured communication method unless specifically instructed.
When you provide a telephone number or email address, you authorize Clearpath to respond using that contact information.
You are responsible for notifying Clearpath if a particular communication method is unsafe, shared with another person, or should not be used.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any legal action concerning these Website Terms must be brought in a court with jurisdiction located in Los Angeles County, California, unless applicable law or a signed service agreement requires otherwise.
Before filing a lawsuit concerning these Terms, the parties agree to make a good-faith effort to resolve the dispute through written communication.
Notices concerning a dispute should describe the nature of the dispute, relevant dates, the requested resolution, and contact information for the person raising the dispute.
Any arbitration, mediation, jury-trial waiver, or class-action waiver applying to paid services must be stated clearly in the applicable service agreement.
If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. An invalid provision will be interpreted or modified only as much as reasonably necessary to make it enforceable.
Failure by Clearpath to enforce a provision of these Terms does not waive the right to enforce that provision later.
A waiver is effective only when made in writing by an authorized representative of Clearpath.
You may not assign your rights or obligations under these Terms without Clearpath's prior written consent.
Clearpath may assign these Terms as part of a merger, reorganization, sale, transfer of assets, or other lawful business transaction.

These Terms and the Medical Privacy Policy constitute the entire agreement concerning general use of the Clearpath website. They do not replace a signed sober companion service agreement, authorization, release, payment agreement, or other document governing actual services.
